Grinding Going Into 3rd

My transmission headaches continue...

The History: When I rebuilt my engine I found my trans was very low on fluid so I ended up having a shop but in all new bearings and install a RAM Powergrip clutch. It drove alright after that until my RAM clutch had its release bearing fail after a few hundred miles. I had the shop install an Auto Zone clutch (just to get the car back on the road until I get my new warranty clutch).

The Problem: Ever since then I have had an issue that when my car is just started and still cold, the trans grinds a bit when shifting into 3rd and only with 3rd. This goes away when the car is warmed. Any ideas as to the problem?

The shop will cover it "if it was their fault" but I am tired of continueing to pour money into this stupid trans. It had been at their shop more than I have driven it since June.

I also found someone give this as an explaination to someone who had a similar problem a while back:
