need legal advice......please help

Angry need legal advice......please help

well, i bought my GTP from a used car place in western MA (name withheld until i get my money, youll see later.........) and what i paid for (this was in november) was the cost of the car ($10,000), plus a warranty ($1400) plus money they needed to get back to me for sales tax (credit union cut me one check, not two). the total amount was for $11,700, so they owed me $300 back. they cut me a check and it bounces. so i get stuck with the fees (nominal amount, no biggie, but still irritating). so now im waiting for my warranty paperwork. 1 month goes by and i call (and call and call and call), and finally i get him and he says a few weeks and itll be all set. long story short, this happens (one excuse after another) over and over until finally at the end of april i say F IT! give me my money back! i dealt with it nicely and drove OUT THERE to make sure i got the check, since i was skeptical to whether id ever see it if i watied for him to mail it. so he cuts me the check for $1400 and im pretty happy. well, i deposit it and i get ANOTHER NSF letter. so now i still dont have my $1400, and this jackass doesnt return my calls and is never there anyways. the suck of it is is that i bought another used car warranty and if i dont get that money im SCREWED. im at the end of my rope here, 6 months+ and i dont have any of MY money back yet, its total BS. im at the verge of legal action here, cuz i know he isnt broke, hes opening another lot a few towns over.
what the hell should i do? what legal action do i have against him if it comes to that? bottom line is i need my money asap.....

cool, thanks for the advice. maybe ill call a lawyer out near him and meet up and pay him a visit. BTW, i dont want to mention the name in case (for some godforsaken reason) he appears here and sees my thread. ill give him until the end of the week, and if he doesnt rectify it ill call the PD and BBB.

Yo Bri, you wan't me to go down there and crack some skulls for ya. I'm sure the easiest thing to do is to get a lawyer and then both of you go have a talk w/ the guy. I"m sure you must have a relative who knows a good lawyer who would be willing to go down there with you. Dealing with the cops or hiring a lawyer and going to court is a PIA, your other best option is calling the BBB.

thanks dan, i appreciate it, but even i could take this guy! like i said, im a damn patient guy and those who know me know this. ill give him till the end of the week to get his *** in gear, if not ill get it in gear for him. hes lucky the car is damn nice and is REALLY strong.......or else hed really be hurting!

i would not get a lawyer unless you have a friend who will do it for free. no need to add up additional charges.

go to YOUR local small claims court in your town and file a law suit. you dont have to go to court where you bought the car but where you live. (make him drive to you)

in the mean time i would go to the police department with your documentation and your letters of bounced checks and file a fraud charge in his town/city. thats a felony charge. i would also file a complaint with the better business bearu.

if you get no saitisfaction I would also contact a local news team in his town. being from the western part of the city. this happens all the time. local news teams loves to do fraud on used car dealers. they bust them all the time..

yeah, ill give him until friday, if he doesnt make it right ill get the paperwork all set over the weekend and get things rolling monday. thanks for the ideas and support. as soon as i get my money ill post the place as well as all the crap i went through.
