Is nitrous Street legal....
Is nitrous Street legal....
In the state of Illinois...Im not sure if its diffrent anywhere else buy I have been hearing from some people, that it is completly street legal to have it hooked up and everything, One reason I decided to hide my kit is in case I ever got pulled over the cop couldnt just look in the back seat and be like WTF...I thought you could have the bottle in your car if it was not hooked up, and no pressure in the lines....So i have a remote bottle opener, I figure i would close the bottle and purge it, therefor the cop couldnt do jack $hit about it......
to make it short is it legal to have ?
to make it short is it legal to have ?
I have had a cop ask me if I was a diver
he didnt know what he bottle was lol.. but I told him and he told me to get on it Yeah right
but I dont know in your state.. but I think some kits say 50 state legall..

Research your state laws carefully. In NJ for example, you need a "permit" to be in possession of, or to purchase nitrous oxide. And it isn't a "motor vehicle" law, its a "controlled dangerous substance" law. Possession of N2O without a permit will expose you to up to 6 months in jail, and a substantial monetary fine. The permits are free, and they are issued for the purpose of "race car/vehicle". Some shops will not fill your bottle if you can not produce the permit. I have my permit laminated, and taped in the hatch area next to the bottle.
I thought you could have a nitrous system hooked up that it just couldn't have any pressure in the lines or be in use on the street. But I have never checked the law here in IL to find out for sure. What is the penalty in IL if you have your line hooked up but you aren't using the nitrous?
I will have my ex-father in law look up the Illinois law for me & I will post it, he is the Chief of police in Westmont this is just what he told me about the line to the bottle being disconnected but I will try to get the exact law & how it is written.

Now a $25 fee..
Is it correct that it is good for 2 years only? And a permit is needed for each refill location you might use? [Or can you get it refilled anywhere?]
Also, does it allow transport anywhere in NJ, or just 'to and from' the purchase location?
Re: Is nitrous Street legal....
I guess I got lucky... I renewed mine on 5/13/2004, and there was no charge. It's good for 2 years.
In theory, you need a permit for each "source of purchase".... The form actually comes with two copies, one for you and one to give to the source. Although I have had people ask to look at the permit before they would fill the bottle, no one ever asked to keep a copy and no one ever said anything about the fact that their name wasn't the one listed as the "source".
I did get two permits, and showed "Ken Barnaby" as one (he's runs the refill shop at Englishtown) and Shore Motorsports in Howell. Shore Motorsports does bottle DOT recertifications, and they would not accept my bottle until I showed him the permit - but at that time, the name shown was Truppi-Kling in Greenbrook, and he had no problem with that.
The form indicates that the person is permitted to "posess, sell or purchase nitrous oxide gas for the purpose set forth." And the "Intended Use" is shown as "Race Car/Vehicle". That would appear not to set any limits on the possession... but would not necessarily imply that "using" on the street was permitted, since its for a "race car".
Check you attorney on that.
I asked one of our club members who is a N. Brunswick PD officer, and he couldn't answer the question about whether it was legal to run with a functioning nitrous system in the car.

Fred:
Yes at 25 a pop you can see why it would be good to only need/have one permit.. that's how I read it, that you need one for each 'source' [but I am figuring they are a bit lax on that as they want your $$.. so just having a valid permit is OK with most..
]
Ken Barnaby is he the guy in the 'Graphics Shop' at Raceway park? Might be best to use him since he's 'at the track', and if you run out there[or need to ever explain going 'to and from' etc.. who knows how bad it'll get in the future]
Also, I am familiar with Shore Motorsports in Howell on Rt 9..
The DOT 'bottle recertification' how often is that required, and how much does it cost? Do they give you a certificate or a sticker on the bottle?
Thanks!
Charlie

I think the pressure certification is good for 5 years from date of manufacture, then you have to have it retested. They stamp a new date right into the bottle, and put the identifying logo from the testing shop right next to it. Shore doesn't actually test them... they send them out. I suspect most welding supply shops could certify the bottles.
