Fan relay was altered

I just bought my Z28 3 weeks ago. I took it to the dealership to get it checked out and they said two things.

1. My exhaust was gutted and I have no catalytic converter. Which is illegal.

2. The previous owner had altered the fan wiring. The fan will turn on when ever I turn the power on to my car. The engine does not need to be running and the fan will be on. They said it may kill my battery quicker.

My question is, will this situation cause my engine to overheat? I realize the reason why the person did it was to keep it running cooler or to help it cool down faster.
I have been having trouble with over heating and the engine sputtering once it gets warmed up.
What are the causes of this?

I have a new water pump in the mail and I will replace the old one. I have changed the head gaskets, intake gaskets, and exhaust manifold gaskets and also the thermostat, spark plugs and spark plug wires.

One thing I noticed when I was changing the head gaskets was that there was still some GREEN anti-freeze in the engine coolant ports(?). The thing is that I drained the green anit-freeze and put in some prestone radiator cleaner, which is clear. I have driven the car around some, but there was still green anti-freeze in some of the engine ports.
Is this a definte sign of a faulty water pump?

He also had a bypass hose for the water pump. And I recently connected it the way it is supposed to be.

Any input would be great.

It was the only Z28 I could find for $4,000 that was 6 speed and only had 110,000 miles, t-tops, and a new paint job.
