Ticket advice please

I got busted last night for racing. We were running on the service road, nobody else was around. When we let off, we coasted to a back down to the limit and then we saw the flashing lights. The DPS made us pull over in a gas station and talked to us for a bit. He ended up not writing us a ticket for racing, but just for speeding. I got a ticket for 91 in a service road. He left the "speed limit" box blank on the ticket????. The violations says "speeding MRIFA" and alleged speed is 91. I am going to talk to a lawyer monday morning that helped a friend of mine get out of a 140 in a 70 ticket. I think he knows the judge, but I am not sure if it the same one that I will be going to. I was also thinking about takling to the judge to see if I could do defferd judification and/or defensive driving. This is my first moving violation ever, im 19. I did have another ticket for tailight out and that was it. Is 36 mph over the speed limit to much for judification, even on a first offense? What about Defensive driving. Any advice would be great.

First, find out what "MRIFA" stands for.... Second, if you do talk to the judge, DONT tell them you were racing... Third, talk to your lawyer, before talking to anyone else..

EDIT: Was this in B/CS?????

I think for defensive drive you can't be more than 25 over the posted limit. Not sure about the deffered adjudication.

Yeah it was in BCS. Who would I have to talk to about getting the ticket lowerd to say 24 over, that away I could take DSC. Is that even possible?

ya for sure its 25mph and over u cant take definsive driving, good thing u werent going 100mph+, you would have had to pay alot more after that 100mph

Ok I got pull over going 97 in a 70 and I found out that you can't do Defensive driving. But you can do defered Judification. It's gonna be like 300 bucks but nothing goes on your record and you'll only have to be on probabtion for like 3 months. As far as the lawyer goes its gonna cost ay more in his fees than to just do derfered.

I got a ticket up in DFW a couple years back on the hwy for going 91 in a 65. 24 over is the limit for defensive driving and the judge was an absolute ***!! He would not budge on anything and was telling me that I was lucky he wasn't taking my license away! It was so bad that my mother, who brought me to court, was in the back yelling at him cause he was badmouthing me so bad. He finally decided to give me deferred, def. driving, and 6 months prob. Plus a $400 fine. Now that might sound bad, but you don't want a 26 mph over ticket on your record, nor do you want to pay for that.

So, moral of the story: As long as your lawyer/or you can get you deferred then you will be much better off than you could have been. And thank the Lord you didn't get that racing ticket, those aren't good at ALL!

as far as not listing a speed limit on the ticket, it depends on the jusdge you take it to as to wether or not he will throw out the ticket. Acouple of the judges I deal with would toss it out. Also I am not positive but I believe the cutoff on deffensive driving is 24 over and defered is 26. The defered is only a few mph higher for the max limit you can be over. If you go before a local judge for a DPS ticket this can sometimes come to your advantage. The judges city does not get anything from the ticket so they tend to be a little more easy on you. Also go talk to the prosicuter for the court you have to go to they tend to make deals with ya if you are cool about it. I have had good luck in doing this with the ones here in the DFW area. Hope some of this helps.

The MRIFA basically means that his patrol unit was moving and he confirmed your speed with his front radar.

It does not cost 300$ for Defered adjudication. They only charge you court fees. And the probation varies from judge to judge....along with the court fees.

For your copy of the ticket the speed limit box does not matter. At 91 you are speeding on any road. He can add the correct speed limit later. The copies he has goes to the court. Your copy is just for your info.

On another note. Both of you could have gone to jail for racing. Its a class B misdemeanor since September of 2003.

haha isnt that the truth, ive noticed i go alot faster w the m6 then i did w the a4, the rpms stay so low in 6th gr, it feels like im goin slow, but w the a4 going like 75mph the car would be loud, so id go slow, maybe i need the a4 but probably not today was gay

Re-read what I said. It varies from area to area. And its not going to be 300.


And if you work at a court house you would know its called deferred adjudication not "defered Judification" like stated in your earlier post.

Well I went ahead and got a laywer so hopefully he can help me out on this one. Thanks for the advice guys.
