Angry **** kicking

Soooooo......4:30 in the morning...... just got back from a party, my cousin is getting married. I decided to drive by my property (~3:15am) that we're developing and I caught someone breaking in to the house.
To make a long story short, I now have a busted 6 iron, a broken cement brick, a bloody shirt and some guy who wishes he never met me. Oh yeah and my hand is killing me.
5 cop cars showed up while I was on top of the guy, talking to 911 explainig what was happening. The officers couldn't believe that I called them while I was on top of the guy. Anyways, I hate these freakin junkie thieves that think they can take whatever they want. Freakin lowlifes!!!!!!!!!!!
Good night...I mean good mornig, gotta go to work @ 7am now

Make sure none of that blood got in you those type people carry desease like rats . Sweet job on ****kicking the junkie !! Im always freaked Id be charged for beating him and have to buy him new teeth and stuff . Next he would say I ruined his style of life and caused him fear of society and I would be the one trying to steel change outa cars to keep him in gucci suits.

Did the police try to charge you ??

The officers were really cool!!! They took my statement and said that if there was enough evidence for the crown prosecutors then they would press charge aginst him. They never mentioned chargeing me, probably because as a home owner I'm allowed to remove someone from my property that doesn't belong there, even with force, as long as it's not excessive.
I was pretty surprised, that when I yelled to them that I had the guy and it was safe to come down (We were obstucted from the officers view because of the guys van in the driveway), they ran down and I told them that I was going to get off. As soon as did they had him roll over onto his stomach. Of course it's never fast enough for them so they "pushed" him over with their boots. After they searched him they cuffed him and took him to the car. On the way there he complained about me hitting him with the 6 Iron on his knees and banging his head off the pavement The officers told him that he was lucky because it would have been worse if they caught him first.
Anyways, one of the female officers saw blood on my shirt and she took me to her car and sprayed my arms and hands with some heavy duty disenfectant. She was pretty nice to me. Stuck around after everyone left to make sure that I was OK before she left.

haha I saved the head. the shaft was sh!tty anyways so it gives me a chance to replace it.

man i've always wanted to be able to beat the F*CK out of somebody and not get in trouble with the law

i sometimes day dream about catching some assh0le breaking into my car and just beating them senseless till they can barely breathe

what does the law say about self defense or if u catch someone breaking into ur car or ur house ?! how far can u beat them before u get into trouble yourself ?

SBains, glad to hear it worked out for you. I am always scared that they might have a second man or even a knife or gun.

As for being charged, you are probably in fine shape because those kinds of guys will not get the Crown to take their case!

Sideways, as for using force, beating the crap out of someone till they are un-conscience is probably excessive.

Having said that, a local store owner a few years ago, wrestled a would be thief to the floor, placed him in a head lock while his father phoned the cops. By the time the cops got there, the thief had died and all this without a single blow. The store owner got off scott-free!

Actually I just read about this issue very recently. In the US you can use deadly force to protect your property, but here in Canada you are allowed to use an "appropriate" amount of force. In other words, you do not get a blank cheque in Canada BUT you are able to use enough force to "win".

I think I "won".
U r correct shaun, we are allowed to use force to subdue or get rid of trespassers. Just not "excessive" force. Not sure about the car thing though because usually u'd be on public property.
