question bout speeding ticket in socal

question bout speeding ticket in socal

i was coming home front fontana speedway ther other night and i got pulled over by brea pd for 'street racing' which i was not because i was just at the damn track-ironic no? well he thought he would be a nice guy and 'just' give me doin 77 in a 45 (it was imperial highway). well my question is i want to fight it so how would i go about getting an extension on my court date, do i have to show up or can i just ask for an extension on the phone thanks

which part are you fighting? Were you not doing 77 or is the speed limit not 45 there? Sorry but I can't help about pushing the date...I just moved here. It's probably best to just call the courthouse and ask (that's what I've done in other states).

the speed limit is 'supposedly' 45 and i 'guess' i was doin 77 but i heard if you push it back then chances are the peace officer wont show and i get off free

Where here is my advise. You got off with a speeding ticket. Even if the cop does not show the just -will- ask you how fast you were going, if you admit to it then you get the full fine and point. If the Cop does decide to show, he might relate to the judge that he let you off easy with a speeding ticket instead of a racing/expidition of speed fine. Either way it probably wont be pretty, I would just pay the bail amount and do the traffic school. Good luck in what ever you do.

In most states, you can postpone/change your court date 1 or 2 times, each time reducing the chance that the officer will show. You should also ask when pulled over to see the radar gun with your speed locked in, otherwise it is just his word, so you can argue that if he does show. I had a cop mis-write something on a ticket two years ago. I went to the courthouse to schedule a court date, and the clerk said the officer made a mistake, and it may be thrown out. Sure enough, when the judge saw the ticket, he dismissed it entirely.

No points, no fine, no traffic school.

thanks, well i know i wont get hit up for reckless driving, drag racing etc cuz he told me and in cali if you get caught street racing its bye bye car. on my ticket he wrote firebird when my car is a formula (well i know its technically a firebird formula) so thats my waay backup strategy if chances are he comes. also i cant do traffic skool cuz i was over 25mph (77 in a 25) in once again dumb CA rules say im not allowed so itd be DUMB of me NOT to challenge.

I got a ticket too for speeding. Just wondering what the officer mis-wrote? My court date is set for next month.

The reason reschuduling is a good idea is because cops have a set day every week that they assign for court, generally. If you get the date moved and it does not fall on that day for the officer there is a pretty good chance for a no show. Yes you can reschedule, and it is probably wise to not reschedule for a monday. At least that is what I would do if I were fighting a ticket I wrote.

My date happens to be a Monday.

In his haste to write my ticket, he wrote 35/45, as in doing 35 in a 45 zone, when he meant to write 45/35, which is what he said I did, even though I had just made a turn onto that particular street. The judge looked at the ticket(cop didn't show, BTW) and said, "Well, last time I checked, you could drive BELOW the speed limit any time you want, case dismissed."

I have esp. No, thats just when most people I work with schedule their dates. Chances are he takes care of all of the tickets at the same time. Change the day day of the week and the chances are he has other things to do.

Good luck... it is hit and miss when it comes to court dates. I've had several speeding tickets. The last two I got extensions and the officer showed up both times.

Ok guy, your car is a Firebird, Formula just happens to be the name of the sub model / package of your car. IE if you had a Civic DX he's going to write Civic, he doesn't really car if you have a DX or an EX. Also, you can take traffic school for more than25 over, I got a ticket for 92 in a 45 & it was 271 for the ticket + 29 for the privilege of taking traffic school + however much traffic school was.
