I got a ticket for 55/50 but the cop was real nice. A motorcycle was pulling wheelies next to me and stuff so i was tapping the throttle but anyways, do you think I can get the pts off my licence if I fight this in court? I really dont want the insurance...
thats such a small amount over. Go ans get someone to calibrate your speedometer. Id go to court cause if you dont it will definately take points off your license because paying it is you admitting being guilty.
I was speeding more than that probably.... In the notes section it says "Warn drag racing" What kind of defense would I have? I would probably have to plead guilty but it is my first ticket.
If he made a mistake like that on the ticket you may have a chance.
Do you know any Para-Legals? they may be able to give you an answer as to the tickets validity.
If you going to plead guilty withan explanation you may as well just pay the ticket,its the same thing.

On the ticket it says "C/I Speeding 55/55"
According to popular belief, which may have stemmed from the old Summary Convictions Act, that minor errors* on the ticket will make it void. This is not true anymore. If your name on the ticket is spelled incorrectly, this is not a fatal error. As long as the right person is standing in front of the court, and the police officer can identify you, the name on the ticket does not have to match your name exactly. Other minor errors, such as license plate, the defendant's address, and license number etc. will not affect the validity of the ticket. The error must be major enough in such a way that it will mislead you into preparing a defence. An example would be an offence that is not known to law (e.g. speeding 40 km/h in a 63 km/h zone.) Other fatal errors include missing police officer's signature, missing defendant's name, identification and signature etc. If you are not sure whether your ticket has a fatal error, it is better to plead not guilty anyway. The judge will decide whether the error is fatal and if so, he will dismiss it. Don't assume a small error will void the ticket and toss it out yourself.

More than likely the cop will not remember the speed that you were doing accurately (how could they remember out of all the people they pull?) and you can get out of it. That is insane. In North Carolina they wouldn't even pull you over for doing that speed. It must be quota time.
I dont know how you handle those, but I will use a lawyer everytime. They'll take yours and change it to 'impeded speed' or something like that, which will be zero points, but court fines will have to be paid, plus cost of lawyer.
In the long run you are better off getting any ticket squashed.
And it's always usually good to get a lawyer from the same city you were pulled over in, they usually are in good gracious with the judge.

The cop made a typo on the ticket. No where does it say by how much I was speeding but where it says 55 in a 55. He meant to say 55 in a 50... This seems like a pretty big error if you ask me
How can the cop "change it" to impeded speed if the ticket has already been written for going the speed limit!

Man, I wish I would have known about that, I had to suck up 2 points for an improper turn last month, That really sucked!!!
I fight EVERY ticket ubless it was so clearly obvious I screwed up and he gave me a break (like a few weeks ago when I was going 77 in a 55 and he wrote me for only 5 over).
Here's the thing: If you fight it, and he doesn't show up, you win. I'va had that happen several times now. The ticket gets dropped right then and there with no explanation from you. It is pretty common for them not to show up believe it or not. If he does show up, then worst case that will happen is nothing changes, and you just bought yourself a few more weeks to pay the fine. Just tell the jdge that you weren't drag racing, there was a motorcycle doing wheelies next to you trying to egg you on and the cop must haveassumed you were playing with him when in fact you weren't. And the speeding was not under your control. The speedomoeter said 50, if it was going 55 then it must be out of calibration. This won't help a lot because speeding is not what they call an offense that requires intent. Meaning: you don't have to intend to speed to still get written up for it. But quite often the magistrate will lower the offense, or you could ask for leniency if he doesn't buy your story and see if you can get on with no points.
C/I 55 in a 55 means Civil Infraction, and you CAN get a ticket for 55 in a 55 zone...it's called too fast for conditions. Usually you get something like that if the weather is bad or traffic is exceedingly heavy or something.

personaly I think you are screwed, not because of the speed, but because of the drag warning....
They can't change the ticket after its been made. Who cares what the posted speedlimit was... He said it was 55 and thats what the law looks at.

he got YOUR actual speed right. I would think thats the important part. it will say on the ticket somewhere the location that the ticket was given. it isnt hard for them to figure out that the speed limit he put down wasnt the posted limit. now if he had put it down that you were doing 50 in a 55 THEN you would probalby have a really good chance.
