What are the downsides to no egr or air
In NJ you will fail a "visual" inspection. Causes codes and the SES light if you don't have the diagnostics programmed out of the PCM. If they don't program them out correctly, you may get a "system not ready" flag for each, and too many of those will fail inspection. NOx emissions will go up, it they put it on the emissions dyno.
AIR helps the cats heat up faster on startup, running for about three minutes or so. No downside to removing it, other than increased emissions on cold start. Also no performance gains, other than the loss of a few #'s.
EGR helps cool combustion temp down mainly during low RPM cruise conditions, when you try and lug the engine in the wrong gear. Reduces oxides of nitrogen, and helps reduce the potential for detonation. Again, if you remove it, there is no perfromance gain. EGR only works below 3,500rpm at part throttle.

I don't take my car through NJ inspection any more, because its a "track" car now. But when the stroker was first built back in 2000, I was pushing 500 flywheel HP, with ALL the emissions equipment intact and functioning, including the cats, EGR, AIR, EVAP. It would pass the rolling/dyno emissions, and I knew a shop that would do the full, honest emissions, but overlook the fact that nothing in the engine was stock and the cats no longer matched the stock configuration. But back then, the MVC had the "mobile emissions unit" that would set up on the side of the road and do full dyno and visual emissions checks on cars pulled off the road at random. I was afraid someone would "notice" the mods on the engine, since the guys in the mobile unit had full manuals, and detailed knowledge of what they were looking for. The mobile inspection units seem to be limited to deisel truck checks now, so its probably not a problem like it used to be. I never actually had a problem with AIR/EGR because I just left it there.
The shops are not likely to "cheat". The MVC sends rigged cars into their shops, and if they don't find all the violations, they get a summons to a special court that deals with "emissions" violations only. The shop will lose their license, and the owner can be sent to jail for 6 months.
