I don't think their is anything wrong with it, but it will not give you 10hp. More like 2 at the most IMO.

Sport Compact Car tested it a while ago and for most of the RPM range the cars they tested with it actually lost whp on the dyno. There were a couple spikes or small tiny bumps of slight hp gains but nothing significant enough to outweigh the losses.

More like -5. Since when do restrictions in the intake add horsepower?

It was also tested by a reputable head shop that showed it swirled air but gained nothing in way of flow advantages once the air hit the intake/heads/etc. In other words it's one of the most useless items being sold on TV today...

Yeah I love the dyno tests that they have on commercials for it too. You know they probably run one test with 87 octane and the other one where they have their product installed with 91 octane or something or colder air lol.
