Car buyers sue Ford over limited edition vehicle

"Drew Conner of Bardonia, N.Y., and at least 100 other people are members of the class seeking a jury trial and more than $12 million in damages."

"The class action lawsuit on behalf of a New York man and other buyers of the 2007 Roush Stage 3 BlackJack vehicles claimed they paid a premium price of nearly $59,000 (30,000 pounds) last year because Ford advertised that only 100 would be made.

The lawsuit, filed in U.S. District Court in Manhattan, accused Ford and Roush Performance Products Inc of manufacturing at least 100 more of the vehicles in 2008."



OMFG.

100 people x $58k/car = $5.8 million total purchase price of all new cars combined, but they are after $12-million total "damage"... more than TWICE the original price of the car.


I hope this gets thrown out of court, and they lose their ***** paying legal fees and attorney fees for the fruitless effort.

This will do WONDERS for those of us wanting Ford, GM, and Chrysler to keep making the specialty cars with low production numbers, huh?

 

Is that 100 07 models and 100 08 models?
Or is it 200 07 models but built in 08?

 

Well. they did pay for the "exclusivity" of a limited production run. These cars were probably sought as collector cars. However, they bought the 2007 m/y & they built more 2008 m/y cars. So, I don't know why it's an issue.

 

They're just pissed that they were stupid enough to pay 60K for a mustang

 

I see their point, actually... but I think, as is typical in these sorts of things, they are suing for too much.

 

You always high ball it though. That way if you settle at "half", you made out.

 

They have the only 100 made in '07. Besides unless it's stated somewhere that Ford will never make another version of this etc. then they are **** out of luck and i hope Ford counter sues to make 'em pay for all the legal fees.

 

I don't see how Ford has anything to do with this.

 

I don't know about everyone else but isn't Roush tecnically the company selling these cars? I mean it is a car that Roush bought from Ford that was sold through Roush certified Ford dealerships. I don't think that Ford Corporate has any liability for these vehicles.

 

If only 100 2007 models were built then they are out of luck I'd say.

Also what is unclear is, HOW did ford tell them that only 100 would be made? Was is a salesman yapping his trap once he had a buyer on the ropes, was it a flyer in black and white, did they see it on the internet, was it a press release, etc? The form of communication could be a linch-pin to the claim.
I doubt Ford had ANYTHING to do with it actually... betting that Roush decides how many of what he wants to make. Ford simply supplies Roush with GTs to do whatever he wants with them. That's my hunch.


Still guys, think of how something like this could affect our future prospects for "cool cars" that are modified versions of cookie-cutter units.
Camaro, Mustang, Corvette, Charger, Challenger - any and all of these that have factory-backed modifications to produce a "limited run". I can see Ford, GM, and Chrysler walking away from liability issues over something as stupid as this. It just makes unique models even that much LESS appealing for the OEM's to provide us.

 

That is just absurd. Since the value of the additional car package has been compromised, only a percentage of the value of the extra content they paid a premium price for should be awarded. Heck, even the entire amount of the extra content but not enough to buy two more complete cars because they buyers are not out that total value.

 

Honestly, I doubt they are out a single red cent.
NONE of these cars are plummeting in value.
In fact, it is surprising how they are defying any depreciation at all.

Good point! However, I would be a bit annoyed with the situation myself if I were in their shoes. Just not "2x the purchase price" upset.

 

I can kinda understand them being upset, but seriously another 100 cars isn't going to hurt the price. If anything i will make a unknown special edition more known, and they do have the 1st 100 cars...
