passing emissions laws

i was planning to order an exhaust cut out for my car the one that you can just unbolt 3 wing nuts and your running open exhaust, and then when you want to run regualr exhaust just put the cap back on, somebody told me that my car woldn't pass the emissions check with that on it is this true? has anybody else had problems with? i have a cat and everything is fine i just want to know if it will pass with cut out welded on?

When you put the cap and wingnuts back on, you will pass.

In Ca, if you place it in front of the cat ... that is a no-no (can bypass cats). But after, you shouldn't have a problem ... even if it is opened. The muffler is not an emissions device, anything past the cats is not an emissions device (fact!). The only problem you could have is a city ordinance for noise regulations.
