Post Will no EGR pass PA emmissions?

My car hasn't been running right the last few weeks and I have checked several things, O2's readings look good, replaced the plugs, new PCV valve, and a brand new cat. I was getting an SES code though 0400 (EGR) off and on due to a lack of backpressure (I think) since my header install earlier this year. I'm thinking this could be part of my problem now. I did have the EGR valve replaced last summer under warranty but I don't really want to mess with taking it to the dealer again and having a new one installed since it didn't seem to work right without backpressure from the new exhaust anyway. I want to just block it off now, don't really care if the code comes on as long as it's not effecting performance anymore and I will get it programmed out later this year anyway.

My main question is will it pass PA emmissions (Chester, CO if that matters)without it as long as it passes all other categories? I have to take it back for testing this week (failed recently) but don't want to remove it if it's going to give me more of a problem passing
