Going to court for MIC, any tips?

I was at a party a couple of months back, got busted, most of the people there were college freshman/sophmores, so were all under 21. I was the designated driver for the night, got there about 9, drank half a beer, party got busted at around 1. I blew in the breathalyzer at about 2, blew a .014, legal limit is .080. Think I could get away with saying I had been chewing gum all night or something? I don't see how I still blew anything, but hey, I blew the lowest out of everyone there. Oh well, anyone got any suggestions on how I may be able to get it dismissed or get the fine lessened without getting a lawyer?

What are you being charged with? What is MIC? Minor......

I would just tell the judge the truth, you had a drink or toast with your friends at the beginning of the night and just hung out to take all your buddies home. Do you live at home? If so, say you had a drink with your parents at home and later that night your friends called you to come pic them up since they were trashed and didn't want to drive home drunk. .014 is low, I'm surprised it was still in your system, did you eat a bunch or something? Food will actually slow the absorbtion rate down a lot so it will actually take longer to go through your system.

Minor in Consumption. It happened while I was at college(UNT). It was out in Sanger. I had a hamburger right after I drank it. And then I chewed gum all night, up until right before I took the test, which I honestly think is what made me register. I like the real strong mint gums that supposedly have some alcohol in them.

I would wait to see what your buddies get interms of fines and community service or whatever. If it's worth it get a lawyer, if not tell the judge the truth and hopefully he/she will go easy on you since your story makes sense and you were being somewhat responsible. You had a beer, what underage kid now a days doesn't drink, you were at least responsible enough to have only one and just hang out with your friends instead of getting trashed.

Yeah, hopefully nothing to bad happens, court is tomorrow morning, so we will see.

Oh damn, I thought you were talking about some time in the future, not tomorrow morning, that sucks. Have you heard from any of your friends or are you all going in there together?

if you plead no contest, they will most likely make you pay court cost, do community service, and take an alcohol awareness class, and if you don't have any more violations when you turn 21 you can petition to have the record removed.. I think it is called expunged.

i think your going to have to plead no contest either way...if your going to say anything aout a beer then technically you were MIC...if your going to say it was your chewing gum then you can plead not guilty but idk how that will go since you blew and it registered, i would think gum would be like .06 max

you will not get the conviction expunged if you plead no contest, well at least it will be very unlikely for you to do so. There really isnt much you can do other than fight it (which I don't think you have a good enough reason to get off) or just chalk it up to making a poor decision. Not that being a designated driver or drinking half a beer is a poor decision but blowing in the breathalizer is a very poor decision. You should almost always turn down a field sobriety test, especially if you are drunk!

Sorry if this is too late, but how about this? You had a hamburger, right? Say your buddy made hamburgers and told you it was made with Jack Daniels sauce. You thought he meant the JD BBQ sauce, but you found out later that he had actually put JD into the meat before they cooked it. Hence, .014. Honest misunderstanding.
