this mornings speeding ticket and how to dispute it

this mornings speeding ticket and how to dispute it

ok this morning, i was damn tired.. anyway, going north after the tunnel on the 99, doing 140, having to undertake all the ********* who drive slow in the fast lane... and then i saw this cop on the side of the road... by time i noticed him and started slowing down, my detector was going nuts... but it too late.. he's already starting up his bike..

he comes and pulls me over, i winde down my drivers window.. but he goes to my passenger, so i have to winde it down, and then he says "i pulled you over for speeding and having tinted windows, license and registration..." (i have side tint.. but not very noticeable)

he doesn't really talk to me, just the usual, whats your name/address/is this your car... he never says how fast i was going... then 'i'll be right back'

he comes back with a ticket, now here's where i think it gets interesting... its a preprinted speeding ticket, which under the offence part has "Speed against highway sign" ... $173.00, this was computer printed on there..

then underneath it says in writing.. "Tinted Window".... $86

i notice that the dispute location is in coquitlam.. i think thats weird, the last ticket dispute location was in vancouver
and later i notice that at the top the 'on' (as in the offence happened on: ) area it has Highway #1 printed on it, with the number '99' written on top of that...

i'm gonna dispute this, as he never told me how fast i was going, nor was it written down, so i will claim i was just going with the flow... 11% inaccuracy of speedos/radar guns, yada yada... but i dont know what i should do for this...

also isn't it a bit strange about this ticket being from coquitlam (as in the highway 1 printed on there, and the dispute office being in coquitlam)??

any input is so greatly appreciated.. i dont wanna spend $250+ on the government...

definately dispute that.

he didnt tell you how fast you were going..

did he use his radar gun on you or do you think he just assumed you were speeding?


for the tinting, i think you are screwed.

he used radar, but never told me, or wrote down how fast i was going (i know how fast i was going.. about 140.. by time he got me i would have slowed to about 120 or so)

the tint.. yeah, i'm screwed.. i'll live with that, although its only 50%... i could try and get a doctors note (although i dont like that)... or say its a safety film, to stop the window from shattering (Crimestoppers makes this... it could work)

Id take a 180 buck ticket and be cool with it really. IF you were down in southern ca, which is where im stuck at right now, you would be spending some quality time in the california correctional facilities for that speed.
In the same respect, i got popped doing 120 on highway 5, but i knew the cop so....

in canada its in KM/H so 120 is like 70-75 MPH. i think

If there is no record of the speed on your ticket the officer will have a hard time remembering (and thus proving that you were speeding) when you dispute it .

Definitely dispute!

Just be happy you didn't get popped for reckless driving....

I got slammed with that a month ago. Cost me $1,350 to buy my way out of it. I was VERY lucky, and it wasn't fun to deal with..

just to clear up for our american friends, i was caught doing in the region of 120km/h in a 90km/h (most and i mean most do 100+ on this road)... so i wouldn't say it is a reckless driving situation...

and yes, draco, there is no record of my speed on the ticket, nor did he tell me how fast i was going, and this was a generic, computer printed ticket (which makes me think he may have forgotten how fast i was going), unless he wrote my speed in some kind of shift journal... but he is a motor bike cop, and all i saw was him writing the ticket, no computer, no other writing, and when we were done, he just got on his bike and went... i am going to dispute... no questions about that...

You don't have to be flying down the road to get a reckless driving ticket, for the record.... Everyone I've talked to about my ticket, the first thing they say is, "how fast were you going?". Well, it really didn't have anything to do with that at all..

i know this, i just wanted to make sure that ppl didn't think i was going ridiculously fast... i was speeding a bit, but not much more than anyone else... but thats why i got the ticket, now had i been going 180km/h in a 90km/h zone i'd expect to get a reclous driving ticket

I've been lucky enough not to get a ticket in years. I'm over due for one soon. You used to get a copy of the ticket and if he didn't write the speed how should he remember it in court? That's to say if he shows up. My advice to all you speed freaks is dispute any ticket cause alot of the times the officer doesn't show up for court if they have more important work pending that day. I never liked full window tinting, I like to stare at the competition eye-ball to eye-ball plus the chicks can't check you out either with that dark tinting. Maybe when I'm older, bald and grey I'll tint my windows so no one will see an old geezer driving a nice car.

hey drumhawk - dont say you're over due... that might be asking for trouble

the thing is my side tint isn't dark at all... its only 50%... the cop only saw it by chance... but i'm gonna get a doctors note to say that i 'need' it... it actually works sometimes... and if not, oh well

i had so many tickets i've won in court its sick
1- excessive speeding
2- Driving w/o consideration
1- speeding
1- no "N"

good for you ollie... but pease, when you have a spare 10 minutes (or 1/2 hour), give the juicy details... they're some meaty charges you had against you, how'd you get out of them
