I can't give legal advice but there are some good websites to answer all your questions.

I took a Chevy dealership to small claims court when they mysteriously lost my keys and my stereo disappeared. Basically, you're suing the company, not a person. I don't know what your situation is, but I recommend finding all the receipts you need for your case. The guy from the dealership basically stood there and lied to the judge about everything he said to me and that really pissed me off, so be prepared to put up with that kind of BS as well. Any other questions, PM or something. Good Luck.

Re: small claims court

The first time I went to court, the judge tried to make it look like it was my fault for not contacting my insurance company (who already said they wouldn't cover it). Then I went back a second time and told him they wouldn't cover it (I had to have a written statement from the insurance company). He asked the guy from the dealership if the lot was fenced in. He said yes. The judge told him he was liable. I ended up winning.
