Rearend Fried! Need help Plz!

Rearend Fried! Need help Plz!

Went to Gainesville Gatornationals to watch the races last Thursday. After driving 150 miles I stopped at a rest stop & smelled rear gear oil. Alot of trucks around... didn't think much. Stopped again after another 130 miles & smelled it again... uh oh? I was about 60 miles from my destination & had not heard anything bad; also had to do something I couldn't stay there. Drove about 20 miles or so & the whining started, turned into growling & had to pull over.

I called GM & had it towed to the nearest GM dealer (13 miles; whew).

They were real nice & helpful. Except one thing. They said my warranty had expired? Bought the car "new" 10/23/01 & GM sez car warranty started 10/5/00: special event/used car! News to me! I was told at purchase it appeared at the auto show & I was also told 1st owner, new vehicle, and full warranty from the purchase date. My sales receipt sez new; financing agreement sez new!

It cost me just under $1K.

I am disputing w/GM & the consultant stated I have a strong case.

Another plus (a biggie too!);

Thing is I had my car in the local GM dealer 10 days ago to do some simple warranty work (N/C of course/while I have no warranty?) & I remembered Ed said I had a little fluid around my rear seal (thanks ED! lol; I know you were only helping). They changed the rear end seal; no charge!

The out of town dealer states on my receipt "ring pinion nut overtight; damaged bearings". The Fricking dealer trashed my car! Thank goodness GM stated so.

Only thing is... I now here a squealing/squeaking sound when I turn or back up? It doesn't have to be under power or anything? WTF is that? I fear there is something more.

Heres where the help comes in...

1) any idea on squealing/squeak... ring pinion misaligned, shims? clutches? fried? It must have gotten red hot in there for 100's of miles! They took the axles out & changed 4 bearings & flushed it 3 times. They said they didn't see anything else? looked ok?

2) Going to dealer 1st w/all receipts & (unfortunately) will attempt to have them look & fix this now as well as reimburse my $1K. Meaning the culprits have to work on my car.

3) I want my 7 months of warranty that the manual sez I get with a new vehicle! Regardless of what GM records sez; I got sales receipt; "new vehicle" box checked, Finance papers "new".

The local dealer (Sales Mgr) had a chance to say "under warranty" when the GM service rep/GM cust svc called. They said he pulled my invoice & said "no special note of 36/36,000 warranty". Duh; whos does when you by a new vehicle & are informed full warranty... I am thinking consumer deception here.

Any ideas to my three issues?

Pleeeeease.

Go to the dealer where you bought the car. If that does not work call the GM corporate complaint line 1-800-GMB-ITCH. Do not give up.

When you buy a new car the warranty doesn't begin until you take delivery of the car. Back in 1996 I bought a 1995 Formula that sat on the lot for like 5 months and the warranty 3/36 didn't start until I took delivery of the car. If GM denies the claim then the original dealer who overtightened the pinion nut/seal is responsible for the damage they caused.
