Is this spoiler fixable during paint/prep??

So I just tried to test fit the spoiler I recieved today, and while doing so I discovered one of the tips is cracked... here are a couple pics.
They actually look worse in the pics as they are so big, it is a relatively small area affected but I'm still concerned.








Also, I've never gotten a new spoiler or hood or anything, and am not sure what really makes it a good fit or a bad fit. It does not fit perfectly, but from some pics I've seen of hoods it is fitting pretty well.
Dont have great pics of the fitment, but here ya go..

This is from the back, looks fine from here:


This is the worst of the two sides, it sits higher than it should, but it is just resting and not bolted down:


This is with my hand pressing down on that side, it fits a lot closer to the body lines with some pressure, i'm hoping when bolted down it will sit fine:

Who did you get it from? That is deffinately not acceptable though, and i would get a different one if possible. It is fixable but if you can get another one that would be better.

There Going To Say It Is The Shipping Companies Fault. If You Were To Fix That It Woulg Most Likely Come Back Because Your Spoiler Is Always Flexxing So Youd Be Lucky If It Was Fixxed For A Mounth

It's definitely way out of whack. You're going to end up paying a body shop more than what you paid for the spoiler to get that thing to sit properly. I'd tell them that you want either: 1. a replacement (with return shipping paid) 2. a full refund (also with return shipping paid) or 3. Them to foot the bill to have that piece of crap fitted. If you get a refund for it, bone up the extra money and get a higher quality piece. Saving money in the beginning usually ends up costing you money in the end.

the fit,ent on that is verry poor. like everybody else said send that thing back and demand a refund. even i couldnt make that work without putting in atleast 30-40 hours on it.

the crack is easly fixable but the fitment is so bad that it would require so much work that its not worth it

I got it from a person on ebay who seems to have sold a few of them before.

Not a lot of feedback on this person but what they do have is 100%.
From the email or two ive had back and forth it, plus the fact they have sold a couple of these, seems like a company and not a private seller.

Just got off work and i'm going to sleep but Ill post some more info tomorrow if I get a response from them.

i sent him a message the last two days and he has not responded yet.
I plan to take the spoiler to DHL tomorrow and see where I can get with them since I do believe the crack happened during shipping. To be honest i expect resistance from DHL though... should they not refund me in full for the cost of the spoiler and shipping my next step will be one more attempt at contacting the seller before filing a dispute with ebay and/or paypal.

Talked to DHL today. DHL says that the person who paid DHL must file the claim for a damaged item, and therefore I cannot file the claim.
The seller emailed me back today and says he is out of town, but did sound somewhat concerned and willing to help. After reading one of my first emails he suggested I file a claim with DHL and that they would repay me, he offered me a 20% discount on top of that for the trouble and the complaints I had regarding the packaging. Apparently once he read that he would need to file the DHL claim he stated he would do so and be in touch.
I feel like I atleast made some progress since he responded back to me but I'm still less than confident as to how this will turn out, especially since I dont really have a lot of confidence in shipping comanies - I work for UPS.
This was my first time using ebay.
