Your story is very similar to what happend to my mom about 9 years ago.

We had pulled up to a intersection with a 2 way stop. My mom was at the stop sign, and pulled forward to check. There was a bush to the right of us, and my mom checked once, didn't see anyone. She pulled forward and from the right side a Honda Del Sol came flying (from the skid marks it was said she was doing nearly 45mph in a 25mph zone) into the passenger side fender, just in front of the tire.

Though the lady was proven to be doing 20mph over the legal limit it was my moms fault because she had the stop sign. The other driver had right of way despite her speeding. So, that is something to consider in your case.

BTW, you never mentioned it. Were you able to give a statement to the officers? If you haven't given a statement yet, then the officers can't write a report until you do.

I was in an accident on the highway in late december of 2003. I had gotten behind a Infinite G35 on an expressway entrance ramp, and the G35 driver decided to do about 25mph on this ramp. The ramp is a WIDE clover leaf, you can safely take it at up to 45 or 50mph in the average car (my GTA took it over 70mph for fun one day..) So the guy was going really slow and when we got parallel with the highway I punched it and scooted into the next lane and tried to pass the G35. The G35 didn't like that, so accelorated in front of me and slammed on the brakes with less than a car lenght between us a 70mph. I swerved left to avoid him, missing his car by inches and when I straightened the wheel out my crappy Escort couldn't handle the weight transfer and the rear end stepped out to the left. At this point my head lights were shining directly at the driver side door of the G35 and were dead even in the lane. I saw I was going to hit his door and pulled the wheel left, the front turned really quick and the rear end snapped back towards the G35, clipping his 1/4 panel in the process with a golf ball size dent near the lip of the wheel well. I spun 3 more times before regaining control of the Escort and pulling off to the side of the highway. My escort had a smashed tail light, and the plastic bumper had shattered near the same spot. The G35 had a golf ball sized dent.

Not having a phone the G35 driver was the first to call the police, he tried to press criminal intent and have me arrested. In the end no-one was arrested but I was considered 100% at fault for th accident. I fought it, but all I could get was a 70/30 split from the insurance company. In his statement the driver of the G35 stated, "I passed him after the merge lane ended and then brake checked him." Which coincides with my statement. The driver of the G35 also stated, "He tried to run me into a concrete divider...." But there wasn't a concrete divider (I brought pictures).

In the end, I was listed by the officer at 100% fault, but due to the pictures and statements I was able to get it to 70/30 split, my fault. Its stupid I know. But in this case, the 24yr old college student driving the old, ratty, econobox stereo type made me out to be the scape goat.

So yeah, if you drive a ratty car, or a thirdgen, you will get stereotyped and cops will say you are at fault JUST by seeing the cars involved.

Well your car is a disaster dude ,but it probably saved your life as well,it did what it was supposed to do in a collision,collapse around the passengers(ie. crumpple zones) ,cars are not made to be repairible any more,it sad because you lost a friend ,something you put your heart and soul into ,and now it's gone. You'll get another and in time this one will just be a memory,a story to tell when you are BSing with your friends and you'll look out the window and see your new friend/love setting out in the driveway and smile. thanks for the comments guys. i appreciate all of them.

i love G35s, but i know there are some serious bastards that drive them. any nice car has some money hungry fool behind the wheel that thinks the world revolves around him.

im leaving in a little bit to drive up to hopewell and look at this firebird. if its in as good of condition as this guy says it is, i should have a new car by tomorrow. we'll see. im takin a digital camera with me to take pics and ill let you guys have em by the end of the day i think.

now that i see the pictures,you ARE lucky to be in teh condition you are...man that thing is mangled.

you said the passengers in the 4 runner said u were doin WAY over the speed limit? make sure the judge knows that your car was only a V6 and isnt all that fast (whether it was or not,just make sure his impression is that it was real slow).

good luck looking at the firebird!

I think you need to find out why the other driver was let go without any fault. Sounds like something shady is going on. You should have the other driver's address and name on your accident report. Perhaps the cops let him go because he has a parent or relative on the police dept. and usually that is enough to get all the breaks you need in a situation like yours. He had a stop sign and you didn't, even if you were going 10-20 mph over the limit, no one can prove it. Find out what you can on the other driver. I don't know if your state laws allow it, but in michigan you can go to the DVM and get the other drivers driving record and check his history out for a fee.

Chilling! That is really all I can think about. It is amazing that you got out of that with only minor injuries. But, the good news is that it shows you GM has some clue on how to make safe cars, at least back then they did.

that's some really good advice, jzajac1. I'll look into that. the kid was driving a 4 runner and he's not even a senior in high school yet. that tells me he has money (like almost EVERYONE around here, cept me) so maybe there is some connection in there somewhere. I met his grandfather at the tow yard where the cars were the same morning i went to look at my car - he was taking pictures. He didnt seem upset at all, didnt sound like it was a big deal one bit, and in fact he offered to take some pics and send them to me of my own car! Now that you meantion it, unless his grandfather is on heavy amounts of valume, it doesnt quite add up. I tried calling the kids house just to say i was checkin up on him and making sure he was ok, but nobody answered and i havnt gotten a call back yet, so maybe they arnt quite as calm about the situation as he was.

I finally have pics uploaded of the firebird i went and look at yesterday. I couldnt find a camaro with the 350 TPI engine for anything less than 4 grand, and that one had some internal work done to it (crane cam and roller rockers, JET II chip... bunch of other stuff) and id love to have it, but i cant afford it at all. I think you guys will be impressed with this firebird anyway. check it out:

oh, and Rice Killer, that car was known far and wide, mostly because of how damn fast it looked and the tone of it's engine with the tips i put on it, but it was refered to be all who had seen it as the "VTEK THS" car. I use to go to partys all the time at peoples houses i had never met, and people would run up to me all excited saying "YOURE THAT GUY! with the "VTEK THS" car! that car is awesome! ive seen you all over the place! your car's so nice! can is it here? can i see it?"
it was just.... it was such a beautiful car and i was so proud of it. Im seriously emotionally lacking now that it's gone. It was like an all star child to me. im trying to find somethin to hold me other though. its just not gonna be the same.
I do plan on transfering those plates onto my new third gen though..... unless by some case of extreme misfortune i get stuck with a v-6 firebird. then it'll be my very first car with standard plates, but i dont ever see myself buying one of those.
