Texas Penal Code, Title 5, Offenses against the person § 21.11 Indecency with a child(so-calle statuatory rape)
subsection (a): A person commits an offense if, with a child younger than 17 years and not the person's spouse, whether the child is of the same or opposite sex, the person:
(1) engages in sexual conduct with the child or causes the child to engage in sexual conduct.
Subsection (d): An offense under Subsection (a)(1) is a felony of the 2nd degree.
Felony 2 is punishible by 2-20 years and/or a fine of 10,000
This means that 17(as the law clearly says 16 and down) is legal, but yes, you have to keep harboring laws into account.

Be very careful make sure she really is 17. I have a friend,23, who meet a girl at a club claiming she was 18. He took her home and dated her for a while, come to find out she was really 13
