HELP! I got a ticket....CANNOT GO ON RECORD!

I generally dont speed, but today while i was demonstrating a very bad vibration my car has in uper RPMs only in 4th gear, i got pulled over. it was a less then 10 second bust to 92.....in a 65...

Grrrrrrrr.....Now i dont mind that much paying for the $160 fine, but i cant have this go on my record. I am in training to become a comercial airline pilot and they do check driving records. soooo.....i cant take defensive driving till april(12month rule)...what other ways can i keep this from getting on my record??
I texas you can ask for deffered adjudication, where if you go 6 months, no moving violations, it is dropped(but if you do get a ticket, they both go on and you pay for both :( )

Get a lawyer and have him/her argue it until its either dropped or the judge will accept a payment of the ticket without points on your license.

Another thing to think about. Not sure where you are in your training, or how many hours you have at this point, but it is going to be a few years before the big guys are hiring. If you are going to be instructing for a few years, is that ticket going to matter. You might at that point just want to plead no contest. That is not admitting guilt, but just paying the ticket. That will more than likely get you a fine with no judgement. Still worth talking to a lawyer.

You can go to court and take the fourth option. It is a Florida law where you get no points on your liscense and you get a court ordered Traffic School. So therefore I assume nothing goes on your record. You still have to pay the fine though. That is what my friend did and nothing came up on is insurence. The cop also has to agree to it which 99% they do.

Okay here is a way that is cheaper than going to court for it.

Florida is one of the few states that you can do this in any more.

Pay with a check, hope you got an envelope when he gave you the ticket, but pay an overage. Doesn't have to be that much of an overage just a lil more than the ticket. The state will send you a refund check for the overage amount.

Do not cash it, just tear it up and throw it away. The case is not closed untill you do something w/the check, cash it or deposit it or whatever. The state of Florida, and very few others, can not and will not issue points while a case is still open. Your case will never close untill you cash/deposit or do whatever with the check they send you.

I heard this a couple times before when i got ticket in the past, but i have yet to find some one who has actully done it. Has anyone really tride this? your inssurance stayed the same? can ya prove it?

Also to the guy who asked before, i am pretty much same place as your, soph in college, maybe a 2 weeks till i take my check ride for my instrument rating. I plan on having all my rating and my comercial liecence before i graduate and ready to take the ATP when i turn 23. But they still look at your driving record correct?

Yes, I have a buddy here that has been doing it since he was 16, he is now mid-uppur 20's, says it works perfect everytime.

I guess i will try this, but i hate to gamble with it. so my ticket is for $166, i write them a check for $176 and then the will send me a $10 check in return, and i just tear it up? and because i dont cash it, they cant enterer it into there computer as complete, thus insureance gets no record?

I've heard of that before also, but not sure if it works (I've had enough tickets I probably should of tried it). I would either try that or take the class-the class is the sure way not to get points on your liscense. I dont know about the getting a lawyer thing-maybe it depends on your previous driving record. I got a ticket not too long ago and took it to court with a lawyer and got screwed. The cop said I was racing my car and spinning my tires-so I pleaded not guilty-it honestly didn't happen. The cop admitted he was out of his car writing another ticket-and there was a truck in the lane next to me-so he didn't even have a clear view of my car-at first he said I squealed my tires for 30 feet, then later said I "chirped them". We caught him in a lie--and the judge still found me guilty, is making me pay for the ticket, pay for a 8 hour aggressive driving school ($85) , and the points STAY on my liscense. I got screwed :mad: . I really hate Winter Springs cops. But my driving record (which the judge will look at if you plead not guilty) isn't too good-lots of tickets.

Yep, you don't cash the check = case not closed, case not closed = never gets sent to insurence company.:D

Good luck it will few several years before airlines are hiring anyway 5-7 yrs so with this time frame you will be ok.

1st, I'm not 100% sure on this:

There is a Diference between a ticket being in record, and not having points.

At my auto insurance agency, the showed me a list of all the tickets I have on record. ALL of my previous tickets are shown, even though I did not get points for all of them. I took the class for 3 within a 2 year period (I went to court and they gave me the class for one).

So be sure what it is you want to avoid, the record or the points. If its the points, then you'll be fine, but if its the record, I dotn think there is a way arround it.

BTW, even if you take a class, your auto insurance still knows you got the ticket, but msot wont raise your premium unless you got the points.

I know what you mean about Winter Springs cops. I live in Winter Springs. :mad:
A couple years ago I was on my way home from my dad's in North Florida with a load of furniture in the back of my truck. After putting up with stupid drivers for the past 3 hours I was finally home(less than a mile to go). I went through a yellow light. The light changed to red just as I passed under the light on the far side of the intersection. I could have slammed on the brakes and stopped but with a load of wooden shelves and other stuff I just rolled through. The cop was standing outside of his car at the veterinary clinic on 434 talking to somebody. He saw another of his buddies coming around the bend toward me head on and had him turn around to stop me. He finally got there a few minutes later and wrote me up.

I took it to court. He said he was parked next to the sidewalk observing the intersection, had a clear view of all lanes and was not distracted by anything else at the time(standard BS testimony they throw out for every court case). I reminded him that he was parked next to the building with the rear bumper facing the street and he was next to his passenger door talking to some one in a silver late 80's Celica. He changed his story once I recalled his attention to this. I proved that he didn't have a clear view of the lanes(over 50 yards away from the intersection), he was distracted and he wasn't observing the intersection because his back was turned. The judge waited to rule until the next day. But he still found me guilty and I had to pay the ticket, court costs and got hit with the points too. I'll never fight a ticket in Winter Springs again. Even if you win, you still loose. Even when the cops get caught lying and change their testimony half way through. Isn't that purgery? :eek: Oh yeah. That only counts for civilians.

Anyway, I'd just go to court and ask for court ordered driving school. You don't have to wait 12 months and it doesn't count toward your lifetime maximum. If you have a clean record you'll get off with no problem. I've never tried the overpaying method and don't personally know anybody who was able to pull it off. But why risk it? Do the sure thing. Pay the class fee. Spend the 4 hours in comedy school. Forget about it.

Well here another spin on this.....I have a TX drivers liecence and Texas does not use a point system. so im not should how that fit into the equation. ggggrrrrrrrrrr..i hate traffic cops

Florida has changed the laws, there is no life time maximum any more. There is still the 12 month rule though.:)

i am doing it right NOW! i just got a ticket Saturday night at 1am... becauze right at i got to the light.. it turned RED... i went through and got pulled over...$86 ticket.. i don't want point so i am sending a check for $95 and shredding up anything they send back to me...

if so thats cool because I think I used up my 5 lifetime 4 hour courses.


Comedy class is ok, I prefer online, you jsut ahve to keep a window open for liek 15, 20, 30 or 50 mi. intervals depending on the sectoin and take like a 5-10 question open notes and book test.

you jsut log on skim for 5 min. play Grand theft Auto and kill some cops, then pause it take a test and go to the enxt section and unpause the game.

ive hot about another month to take my completion certificate to the court house for my last ticket.
