MI residents... is this true?

Early this week, a rock fell from a concrete truck on 696, skipped off my hood, and hit my windshield and busted it....

The concrete company said that this falls under Michigan's No-Fault law, and I have to deal with it through my insurance company. I have a $500 deductable... :(

I beleve their is a difference in coverage depending if the rock hit the road first and then your car.

I think you might have to go to your insurance company. If you can prove that they were at fault and that the stone came off of their truck and not simply flew up from the trucks tires then it would be their fault and their insurance company would have to pay it. Call your insurance agent and ask him/her for advice, usually your insurance would kick in and then they would go after the trucks insurance company but it sucks with a $500 deduct. Good Luck.

I have heard that if it was a state owned/operated vehicle then you can make the state of Michigan pay for it.

If not than you are likely SOL.

True to a point. If this was a commercial plated vehicle and he was hauling landscaping dirt, rocks, etc., Michigan law states that he must have a tarp or cover over his load. If there was no cover over the truck bed then they are at fault and subject to a ticket. Even if you are not getting anywhere with them, you can have your agent call their insurance agent and put a claim in for your deductible to be covered, that is allowed under michigan no-fault.

Triumph Auto Glass will pay $250 of your deductable. They did for me when i needed the hatch glass replaced.( I am NOT associated with them in anyway! ) Steven
