waiting for my day in court

so, i bought a set of heads which supposed had 2k miles on them from a guy named Shaun Toombs in Irving. when i put the heads on, not only are they warped, but they also have valve guys that are tore-up from the floor-up. so, i tell him about it and he doesnt wanna do anything about it to make it right. now, i'm suing him, and it's gonna take me like 2 months to get him to court. i KNOW that the decision's gonna be in my favor, and if he doesnt have any money, the court's gonna auction off his camaro.

i hate going through this crap just to get my money back...but, it seems that he has to learn his lesson not to rip ppl off...i'm just waiting for the court date to be determined...after that, it'll be time to roll.

$1100 which is the price of the heads and the labor. before the lawsuit, i would have settled for less, but not anymore.

well, the court will order him to pay within like 21 days, if he doesnt, they'll tell him that if he doesnt pay, his assests will be auctioned off to pay me. if he doesnt pay, one of you guys will get a hell of a deal on a 30th anniversary z28.

I went to small claims court a few years back when a jerk threw a brick at a pickup I was driving and creased the hood and broke the front windshield.

The case went in my favor, the defendent was ordered to pay for damages.

After the 30 day window passed, an injunction was filed in that county, which basically keeps that person from transferring title of property in that county till the injunction is cleared.

That was in 1980 .... still no $$$

Good luck ...

and i quote this from the back of the court papers, "A Writ of Execution may be issued after 30 days from the date of judgement. It authorizes the seizure and sale of the defendant's non-exempt property for the purpose of paying the judgement against him."

so, perhaps the law has changed since 1980.

you, my friend, are in tarrant county. don't expect ANYTHING to happen in 30 days. you'd be in an elite class if it happened in 30 months.

Yep... that was me. I did finally get them on and they are very good. Will try them out at the road course in a couple months.

Did you get the LS1 upgrade done? And your car running now?

yeah, the brakes are fine...well, considering that they've been used for only 5 miles. we installed them, but we've had some obstacles with other stuff....but, hopefully, everything will work out.

it'll be pretty interesting to see what those vette brakes will do to your stopping power. :D i'll have to see you test them out on the track.

Nothing you've already learned...

Have the heads (ANY high dollar part) independently checked somewhere else. Completely inspect/flowed/cleaned/etc.

Good luck in court. The guy I bought the heads from doesn't seem to answer my emails anymore . In all honesty, I don't believe that the guy I bought the heads from knew the extent of the damage on them, but there was so much evidence of N2O detonation (after close inspection) that he KNEW they weren't cherry.

Just like you, I want some response. I am willing to work something out, but the more emails that go unreplied the more I get the feeling he was conning me from the getgo.

Take him to court and rape him.
